How the process works
Every matter is different, but most follow broadly these stages. We will tell you at the outset which apply to you and roughly how long each takes.
First meeting
We listen, explain the options, and give you a realistic picture of where things are likely to end up.
Agreeing an approach
Court is rarely the first step. We look at whether the matter can be resolved by negotiation or mediation.
Disclosure and negotiation
In financial matters both parties provide full disclosure so that any agreement is properly informed.
Formalising the agreement
An agreement on finances is only binding once it is made into a court order, which we prepare and submit.
Court proceedings, where needed
If agreement is not possible we issue proceedings and represent you throughout.
What we will need from you
Having these to hand at the first appointment saves time and cost. Do not worry if something is missing — we will tell you how to obtain it.
- Marriage or civil partnership certificate
- Details of income, property, pensions, savings and debts
- Names and dates of birth of any children
- Any existing court orders or agreements
- Details of the other party and their solicitor, if instructed
Fees for this work
Most of this work is done for a fixed fee agreed in writing before we start.
