How the process works

Every matter is different, but most follow broadly these stages. We will tell you at the outset which apply to you and roughly how long each takes.

  1. First meeting

    We listen, explain the options, and give you a realistic picture of where things are likely to end up.

  2. Agreeing an approach

    Court is rarely the first step. We look at whether the matter can be resolved by negotiation or mediation.

  3. Disclosure and negotiation

    In financial matters both parties provide full disclosure so that any agreement is properly informed.

  4. Formalising the agreement

    An agreement on finances is only binding once it is made into a court order, which we prepare and submit.

  5. Court proceedings, where needed

    If agreement is not possible we issue proceedings and represent you throughout.

What we will need from you

Having these to hand at the first appointment saves time and cost. Do not worry if something is missing — we will tell you how to obtain it.

  • Marriage or civil partnership certificate
  • Details of income, property, pensions, savings and debts
  • Names and dates of birth of any children
  • Any existing court orders or agreements
  • Details of the other party and their solicitor, if instructed

Common questions

Do we have to go to court?
Often not. Many financial and children matters are resolved by negotiation or mediation. Court is there for when agreement genuinely cannot be reached, and we will tell you when we think that point has come.
How long does a divorce take?
The process has built-in waiting periods: at least twenty weeks between the application and the conditional order, and a further six weeks before the final order. In practice most cases take longer, particularly where finances are unresolved.
Does the divorce sort out the finances?
No. Ending the marriage and resolving finances are separate. Without a financial order, claims can remain open for years afterwards — which is why we usually advise dealing with both.
Can you act for both of us?
No. Where there is a conflict of interest a solicitor can act for only one party. Your former partner would need their own independent advice.
