How the process works

Every matter is different, but most follow broadly these stages. We will tell you at the outset which apply to you and roughly how long each takes.

  1. Checking the paperwork

    A great many possession cases turn on whether the notice was valid. That is the first thing we look at.

  2. Advice on your position

    We set out the strengths and weaknesses, the likely timescale, and the realistic outcomes.

  3. Negotiation

    Many disputes settle once each side understands its position. We put your case firmly and in writing.

  4. Proceedings

    Where matters cannot be resolved, we prepare the claim or defence and the evidence to support it.

  5. Hearing and enforcement

    We represent you at the hearing and advise on enforcing or resisting enforcement of any order.

Most of this work is done for a fixed fee agreed in writing before we start.

Common questions

I have been given a notice — do I have to leave on that date?
Not automatically. A notice is a step in the process, not an eviction. Only a court can order possession, and only a bailiff or High Court enforcement officer can carry out an eviction. Get advice before you leave.
My landlord will not do repairs. What can I do?
Report it in writing and keep a record. If it is not put right there are routes through the council and through the courts, which can produce both an order for the works and compensation.
My deposit was not protected.
Deposits for most residential tenancies must be protected in an approved scheme and prescribed information given to you. Where that has not happened, you may have a claim, and it can also affect the landlord's ability to obtain possession.
Does housing law change often?
Yes, and it has been under active reform. We will advise you on the rules as they stand at the time you instruct us rather than on general information you may have read elsewhere.
